dc.description.abstract | El privado de la libertad también goza de derechos, derechos que se encuentran
garantizados en nuestra constitución y en los tratados y convenios internacionales suscritos
por el Estado y ratificados en la Constitución y en la Ley ordinaria, los privados de la libertad
poseen derechos por el simple hecho de ser humano, permitiendo plantear la pregunta ¿cómo
se evidencia el cumplimiento del artículo 12.1 del COIP caso No. 09901202100025? con el
objetivo de analizar el cumplimiento del artículo 12.1 del COIP caso No. 09901202100025,
utilizando como metodología de investigación el enfoque positivista y cualitativo, utilizando
la técnica de entrevista y análisis bibliográfico; se concluye, el incumplimiento del artículo
12.1 del COIP en el caso 09901202100025, que la normativa regulatoria de los centros de
privación de libertad en relación al derecho a la integridad, a pesar de contar con una
legislación acorde con la Constitución, la cual es garantista especialmente de los derechos
humanos, y, ésta a su vez, con los Tratados y Convenios Internacionales sobre Derechos
Humanos, normativa que no se cumple en su totalidad por desidia por parte del Estado. Siendo importante la modulación de la sentencia del caso No. 09901202100025 planteada en
la propuesta de la presente investigación; recomendando, la aplicación de la normativa
existente de forma óptima, eficaz, eficiente y oportuna y, que en futuras investigaciones
profundicen en los demás derechos garantizados a las personas privados de la libertad y, su
efectivo cumplimiento. | |
dc.description.abstract | The deprived of liberty also enjoys rights, rights that are guaranteed in our constitution
and in the international treaties and conventions signed by the State and ratified in the
Constitution and in the ordinary Law, those deprived of liberty have rights by the simple fact
of being human, allowing the question to be raised, how is compliance with article 12.1 of the
COIP case No. 09901202100025 evidenced? with the objective of analyzing compliance with
article 12.1 of the COIP case No. 09901202100025, using the positivist and qualitative
approach as a research methodology, using the interview technique and bibliographic
analysis; It is concluded, the non-compliance with article 12.1 of the COIP in case
09901202100025, that the regulatory regulations of the centers of deprivation of liberty in
relation to the right to integrity, despite having legislation in accordance with the Constitution
and this in turn , with the International Human Rights Treaties and Conventions, regulations that are not fully complied with due to laziness on the part of the State. Being important the
modulation of the sentence of case No. 09901202100025 raised in the research proposal;
recommending the application of existing regulations in an optimal, effective, efficient and
timely manner, and that future investigations delve into the other rights guaranteed to persons
deprived of liberty and their effective complian. | |
