Resumen
Este trabajo de tesis tiene como propósito el estudio de la imposibilidad de renovación
ilimitada del Estado de excepción en el Ecuador frente a la pandemia del COVID-19, en aras
de demostrar si es necesario un nuevo modelo constitucional. Cuyo objetivo será puntualizar
la importancia y la necesidad de adecuar el articulado constitucional sobre el estado de
excepción respecto a la emergencia sanitaria. Para el desarrollo de esta investigación se
utilizaron los métodos de investigación, bibliográfico y analítico. Para la recopilación de la
información pertinente se utilizaron como técnicas investigativas, la encuesta, los documentos
cualitativos, los materiales digitales y audiovisuales. Se empleó muestreo por conveniencia,
donde la población seleccionada fueron cuarenta profesionales del derecho de Guayaquil.
Como resultado de nuestra investigación, se logró plantear una enmienda constitucional para
reformar el artículo 166 de la constitución con la finalidad de ampliar la vigencia del estado de
excepción por calamidad pública de índole emergencia sanitaria. The purpose of this thesis work is to study the impossibility of unlimited renewal of the
State of Exception in Ecuador in the face of the COVID-19 pandemic, in order to demonstrate
whether a new constitutional model is necessary. Whose objective will be to point out the
importance and the need to adapt the constitutional articles on the state of exception regarding
the health emergency. For the development of this research, it will be used in the research,
bibliographic and analytical methods. For the collection of pertinent information, the survey,
qualitative documents, digital and audiovisual materials will be used as investigative
techniques. Convenience sampling was used, where the selected population was forty legal
professionals from Guayaquil. As a result of our investigation, it was possible to propose a
constitutional amendment to reform article 166 of the constitution in order to extend the
validity of the state of exception due to public calamity of a health emergency nature.
