Resumen
El ser humano desde su concepción y en todo escenario en el que se sitúe, sea en el ámbito social, cultural o político, goza de derechos que le son propios dada su calidad de persona, la libertad constituye ser no solo sustancial, sino que es eje fundamental para el goce y ejercicio de los demás derechos. Por lo tanto, requiere que nuestros operadores de justicia, garanticen la correcta aplicación de la prisión preventiva como medida de ultima ratio, con apego a la Constitución, tratados internacionales y otras normativas.
Siendo la prisión preventiva una medida aplicable a fin de garantizar la presencia del imputado al proceso de juzgamiento, resulta necesario analizar la ligereza con la que muchos operadores de justicia la aplican sin brindar las garantías plenamente establecidas en nuestro marco normativo; lo que deriva en abuso no solo de su aplicabilidad sino del poder punitivo del estado a través de sus operadores de justicia.
En el presente trabajo abordamos de manera crítica y objetiva un análisis de la ponderación que debe existir entre la presunción de inocencia y la Prisión Preventiva; sobre su desmedida aplicabilidad, que constituye ser un abuso a los derechos humanos en la interposición de esta medida sin observancia a los derechos consagrados en la Constitución y en la normativa legal vigente, al tenor de lo establecido en los tratados internacionales suscritos por el Ecuador The human being from its conception and in every scenario in which it is situated, be it in the social, cultural or political sphere, enjoys rights that are its own given its quality of person, freedom constitutes being not only substantial, but is fundamental axis for the enjoyment and exercise of other rights. Therefore, it requires our justice operators to guarantee the correct application of preventive detention as a measure of last resort, in accordance with the Constitution, international treaties and other regulations.
Since preventive detention is an applicable measure in order to guarantee the presence of the accused in the trial process, it is necessary to analyze the lightness with which many justice operators apply it without providing the guarantees fully established in our regulatory framework; which results in abuse not only of its applicability but of the punitive power of the state through its justice operators.
In the present work we critically and objectively approach an analysis of the balance that should exist between the presumption of innocence and Preventive Prison; on its excessive applicability, which constitutes an abuse of human rights in the filing of this measure without observance of the rights enshrined in the Constitution and in current legal regulations, in accordance with the provisions of the international treaties signed by Ecuador.
