Resumen
This research aims to analyze the benefits or tax incentives in the municipal tax oneconomic activities in industry, trade, or similar. For the study were considered raised thestandards established in the Constitution of the Bolivarian Republic of Venezuela (1999),the Tax Code (2001), the Organic Law of Municipal Public Power (2009), the ordinancesgoverning the tax on the activities Municipalities economic status Chacao Miranda andJesus Enrique Lossada, Lagunillas, San Francisco Maracaibo Zulia state, as well asvarious authors in this field such as the spleen (2008), Fraga (2006), Quinones (2007),Sanmiguel (2006 ), among others. Methodologically this research was biographical anddescriptive, was used to collect information technology documentary observation of lawsand doctrine using methods of legal interpretation. Consequently, it was shown thatmunicipalities have legislative authority to establish tax benefits or tax incentives assignedto its competence by the Constitution of the Bolivarian Republic of Venezuela, and nationaland state laws and regulations especially in the regime tax on economic activities, all incompliance with constitutional principles and legal precepts tributaries, with the limits. Alsoincluded is what are the exceptions, exemptions and tax rebates under study, given by themunicipalities. La presente investigación tiene como objetivo analizar los beneficios o incentivos fiscalesen el impuesto municipal sobre actividades económicas de industria, comercio, o deíndole similar. Para el estudio planteado se consideraron las normas establecidas en laConstitución de la República Bolivariana de Venezuela (1999), el Código OrgánicoTributario (2001), la Ley Orgánica del Poder Público Municipal (2009), las Ordenanzasque regulan el impuesto sobre las actividades económicas en los Municipios Chacao delestado Miranda y Jesús Enrique Lossada, Lagunillas, Maracaibo y San Francisco delestado Zulia; así como diversos autores en la materia, tales como: Bazó (2008), Fraga(2006), Quiñones (2007), Sanmiguel (2006), entre otros. Metodológicamente, estainvestigación es de tipo bibliográfica-descriptiva, se utilizó para la recolección de lainformación la técnica de observación documental de leyes y doctrina, empleándosemétodos de interpretación jurídica. En consecuencia, se demostró que los Municipiostienen potestad legislativa para establecer beneficios o incentivos fiscales en losimpuestos asignados a su competencia por la Constitución de la República Bolivariana deVenezuela, y en las leyes nacionales y estadales; y en especial en la reglamentación delrégimen del impuesto a las actividades económicas, todo dentro del cumplimiento de losprincipios constitucionales y preceptos legales tributarios, con las limitacionesestablecidas. Además, se consideran cuáles son las exenciones, exoneraciones y rebajasen el impuesto objeto del estudio, otorgado por los Municipios.
