| dc.description | Esta Memoria tiene por objeto realizar un análisis de los alcances que se derivan de la interpretación del elemento “objeto” en el delito de abuso sexual agravado del artículo 365 bis del Código Penal chileno. Esta investigación obedece
a que tanto la jurisprudencia como la doctrina chilena han efectuado análisis exegéticos diversos de la norma citada, sin llegar a consenso alguno, para lo que se realiza un estudio de los argumentos propuestos por los tribunales y autores. Se estudia también la legislación comparada, estableciéndose los problemas allí originados y la forma como se resolvió la disyuntiva, planteándose similitudes y
diferencias con el problema chileno. Además, el autor analiza el alcance e influencia de la constancia dejada en la Historia Fidedigna de la Ley número 19.927, explicando por qué resulta difícil una interpretación extensiva de la norma penal y planteando la necesidad de realizar un
cambio en la actual legislación./ABSTRACT:
This Thesis’ goal is to analyze the range derived by the interpretation of the element named "object" in the aggravated sexual abuse offense, article 365 bis of the Chilean Penal Code. The jurisprudence as well as the Chilean doctrine have done several exegetical analysis of the norm cited, without arriving to a consensus.
This reality has motivated this investigation to study the proposed arguments by the courts and authors. It is also studied the comparative law, presinting the problems that originated
and the way it was resolved the dilemma, considering similarities and differences
with the Chilean problem. Furthermore, the author analyzes the scope and influence of the record given in the Reliable History of Law number 19,927, explaining why it is difficult to a broad
interpretation of the criminal norm and proposing the need for a change in the current legislation. | |
