La contratación estatal dentro del marco del Estado Social de Derecho ha sostenido, entre otros, los pilares de la descentralización, desconcentración de funciones y servicios, los cuales buscan el cumplimiento de los fines esenciales del Estado, siendo dichos pilares de mucha monta y profundidad, pues ahora y en especial a partir de la Constitución Política de Colombia es que el Estado a través de las entidades públicas, cumple sus funciones y ejecuta sus recursos económicos de naturaleza pública a través de lo que se denomina la Contratación Estatal, la cual como lo prevé el artículo 3º de la Ley 80 de 1998, contribuye al cumplimiento de los fines esenciales del Estado, consagrados en el artículo 2º de la Constitución Política de Colombia. La contratación, no sólo consiste en la necesidad de las entidades de manifestar su voluntad a fin de atender al cumplimiento de sus funciones, sino que, constituye, ahora, la forma propia y regla general como se ejecutan los recursos públicos en pro del beneficio común. La contratación estatal es un bloque de normas, de procesos y procedimientos reglados que le dan la hoja de ruta a cada entidad para el cumplimiento de sus funciones, y como tales deben cumplirse en forma cabal, pues es así y no de otra forma como lo ha consagrado el órgano legislador, en este caso el Congreso de la República.
