Se observará que el actuar de los servidores públicos, depende de los valores y principios como seres humanos y la formación como profesionales, factores que se deberían ver reflejados en el buen funcionamiento de la administración y en la ejecución de las actividades propias del Estado, incluyendo la contratación.
De igual manera, es importante concientizar que los recursos designados para la contratación estatal, derivan de los impuestos y tributos que los mismos ciudadanos colombianos aportan con el fin de obtener y recibir mejores servicios por parte de la administración.
SUMMARY
Taking into account the number of administrative contracts currently held, the issue related to the criteria used by the state entities for the selection of contractors is of real importance, in order to comply with some of the guiding principles of the activity Administrative system such as "transparency", which guarantees all citizens that the contractor selected is the one who actually meets the necessary conditions to carry out the contractual object in compliance with the general interest, and in turn must guarantee equality In the access of all the interested parties, so that they have in equal conditions the possibility of concluding the contract with the Administration.
The article investigates the regulatory gap that has existed and still exists in Colombia in the face of the Contract Law and its modalities and generates the importance of promoting serious changes in order to guarantee the constitutional principles of equality, impartiality and transparency, since At present, there are no parameters established in the standard, for the public entity to choose a supplier and / or contractor based on the requirements fully indicated by law, but on the contrary it leaves the free will of the entity, define and interpret Which of the bidders fits the needs of the position or service you are looking for, Allowing the entity to choose the supplier and / or contractor in a subjective manner without taking into account other factors that may be decisive for a good choice in the contracting.
It will be shown through the different judicial decisions the need that exists in Colombia to modify the norm, so that there is a balance with our constitution when invoking the principle of equality, impartiality and transparency when concluding a contract with the state, regardless of its modality, especially if this is the first guarantor in preserving in ensuring the rights, values and principles of our legal system.
It will be noted that the actions of public servants depend on values and principles as human beings and training as professionals, factors that should be reflected in the proper functioning of the administration and in the execution of the activities of the state, including the hiring.
In the same way, it is important to realize that the resources designated for state contracting derive from taxes that Colombian citizens themselves contribute in order to obtain and receive better services from the administration.
