Resumen
The present investigation is related to the events that occurred on May 2, 2002
in the department of Chocó, more precisely in the municipality of Bojayá,
recognized by local, national and international media as "The Bojayá Massacre."
It was a fact that was triggered by the territorial dispute between the AUC and the
FARC-EP guerrilla as a consequence of the state's abandonment and omission,
leaving the civilian population in a total state of defenselessness; on the one hand,
before the direct actors of the conflict and, on the other, by the State agencies that
did not come to their aid at an opportune moment. This situation resulted in a
balance of 119 people killed. Thus, as a result of this situation, the present
investigation seeks to determine the effectiveness of the administrative reparation
of the indigenous communities victims of the armed conflict in the municipality of
Bojayá-Chocó, who also had to live and suffer, putting their quota of sacrifice. To
achieve the above, it has been proposed to characterize the policies that are
applicable to repair the victims of indigenous communities by virtue of the
displacement, as well as the determination of the extent to which it has been
applied to Law 1448 of 2011 and the Decree - Law 4633 of 2011 of the indigenous
peoples on the administrative reparation and, finally, the identification of the main
administrative stumbling blocks that prevent the repair of said communities. It was
based on a study with a qualitative, documentary, analytical and descriptive
approach that allowed the collection, analysis, processing and evaluation of the
information, which led to the conclusion that the State's attention to the forced
displacement of the lower Atrato communities and especially the indigenous, has
been characterized by being disjointed, conjunctural and assistance.
