Razón de estado o estado de razón. La justificación constitucional de los privilegios de la administración pública en Colombia: el privilegio de la decisión previa.

La presente investigación pretende determinar si el privilegio de la decisión previa en Colombia se encuentra justificado constitucionalmente. En el estado del arte, que comprende el primer capítulo, se aborda el privilegio de la decisión previa en Colombia, entendido como la obligación de recurrir en sede administrativa un acto administrativo, como prerrequisito para ser demandando ante la jurisdicción de lo contencioso administrativo. En este capítulo se explica el desarrollo normativo colombiano, y la condición de garantía, carga y privilegio de los recursos administrativos, profundizando en esta última condición. Se presenta la posición jurisprudencial de las altas cortes y de la doctrina. Se aborda el origen de este privilegio teniendo en cuenta la tradición francesa y la española. Por último, se explican las razones a favor y en contra de este privilegio. El marco teórico se presenta en el segundo capítulo. Allí se analiza la fuerza normativa y la eficacia simbólica de la Constitución Política. Se profundiza en el neoconstitucionalismo y el nuevo constitucionalismo. Se aborda la relación entre lo simbólico y lo normativo. Finalmente, se ahonda en el acceso a la justicia administrativa. En este segundo capítulo se determina cuál es el valor jurídico de la Constitución Política con la finalidad de comprender que grado de obligatoriedad tiene el acceso a la jurisdicción como postulado constitucional frente a la regulación infraconstitucional que parece retardar, obstaculizar e impedir el acceso a la administración de justicia. En el tercer capítulo se identifican, describen y sintetizan las razones que justifican el privilegio de la decisión previa, se identifica su finalidad, y se confronta con la Constitución Política a través de la aplicación del test de proporcionalidad. Después de aplicar un diseño metodológico explicativo con enfoque cualitativo, se concluye que el privilegio de la decisión previa en Colombia no se encuentra justificado constitucionalmente. (texto tomado de la fuente) This research aims to determine if the privilege of the previous decision in Colombia is constitutionally justified. In the state of the art, which includes the first chapter, it addresses the privilege of the previous decision in Colombia, understood as the obligation to appeal in administrative instance an administrative act, as a prerequisite to be sued in the administrative jurisdiction. This chapter explains the Colombian normative development, and the condition of guarantee, burden and privilege of the administrative resources, deepening in this last condition. The jurisprudential position of the high courts and the doctrine is presented. It addresses the origin of this privilege taking into account the French and Spanish traditions. And the reasons for and against this privilege are addressed. The theoretical framework is presented in the second chapter. It analyzes the normative force and the symbolic effectiveness of the Political Constitution. There is a deepening of neo-constitutionalism and the new constitutionalism. It addresses the relationship between the symbolic and the normative. And it delves into access to administrative justice. In this second chapter it is determined the legal value of the Political Constitution in order to understand the degree of compulsory access to the jurisdiction as a constitutional postulate before the infraconstitutional regulation that seems to delay, obstruct and prevent access to the administration Of Justice In the third chapter the reasons justifying the privilege of the previous decision are identified, described and synthesized, its purpose is identified, and it is confronted with the Political Constitution through the application of the proportionality test. After to apply an explanatory methodological design with a qualitative approach, it is concluded that the privilege of the previous decision in Colombia is not constitutionally justified.
