El presente trabajo de investigación tiene como objetivo, realizar un estudio exhaustivo sobre el DERECHO A LA LIBERTAD, que se encuentra garantizado y estipulado en el artículo 77 de la CONSTITUCIÓN de la República, así como también evidenciar la problemática social y jurídica que surge con la vulneración de este derecho, el cual es un bien jurídico protegido, que se encuentra garantizado por la Constitución de la República del Ecuador, Tratados y Convenios Internaciones y Código Penal Ecuatoriano, con la finalidad de que sea respetado; y, que en caso de que exista una vulneración del derecho a la libertad sin las causas que prevé la ley, y que además cuya vulneración sea cometida por un agente de la Fuerza Pública (Policía Nacional), sea sancionado sin dilatación alguna de una forma inmediata y eficaz como lo indica nuestro Código Penal y Constitución, bajo la garantía del debido proceso, frenando los abusos de autoridad y logrando que sea reparada íntegramente la víctima de detención ilegal. The objective of this research is to perform a thorough study of the RIGHT TO FREEDOM, which is guaranteed and stipulated in article 77 of the CONSTITUTION of the Republic, as well as to make evident the social and legal problematic that arise from the violation of this right, a right that is a protected legal good, guaranteed in the constitution of the Republic of Ecuador, Treaties and International Conventions and in the Ecuadorian Penal Code, with the finality of being respected; and, if the case occurs in which the right to freedom is violated without the causes stated by law, and if additionally, this violation is performed by an agent of the Public Force (National Police), said agent must be sanctioned without delay in an immediate and efficient manner, as stated in our Penal Code and Constitution, under the guarantee of a due process, restraining authority abuse, and integrally restoring the victim of illegal apprehension.
