This research aims to demonstrate the tension between legality and legitimacy, following the US intervention in Iraq in 2003. This tension is the result of the implementation of democratic procedures that promoted legal changes in the Iraqi government. However, it was the instrumentalization of such procedures which led to a lack of legitimacy of the Iraqi government by some social sectors, due to economic, political and social interests of those groups which were in power. The report provides an analysis about Iraq with some concepts of formal democracy, substantive democracy, legality and legitimacy, with the purpose of understanding in detail the type of democracy that was established in Iraq and the tensions generated in his society.
