Hacia un juicio acusatorio y oral: aspectos relevantes y perspectivas de la reforma constitucional

Abstract

La reforma constitucional de junio de 2008 se encuentra actualmente en un periodo de vacatio legis en que las instituciones que convergen en las labores de seguridad pública y justicia penal deben ocuparse de llevar a la realidad el sistema acusatorio y oral planteado. La intención sustancial de la reforma parece haber sido contar con el aparato normativo idóneo que permita a la sociedad confiar en la eficacia de sus instituciones y garantizar un acceso efectivo a la justicia en condiciones de igualdad para los gobernados. En este trabajo se realiza un recorrido de los principales temas de la reforma para conducir a la reflexión de las perspectivas y retos que implica en lo normativo y estructural. / The constitutional reform published in June of 2008, is in a vacation legis period. During this time, the institutions involved in the public security and penal justice system must be occupied in everything that allows that the accusatory and oral system becomes real. It seems that the substantive intention of the reform is to have the ideal legal system to get the society trust in the institutional efficacy and guarantee an effective access to justice in equal conditions for everyone. This essay looks around the principal items of the reform to refl ect on the perspectives and challenges about the normative and structural actions demanded.
