Alcance del concepto de familia como base para la constitución del patrimonio inembargable de familia a la luz de la legislación colombiana

Abstract

The purpose of this monograph is to identify the scope of the concept of family, established by the Colombian legal system, carrying out an analysis of the legal figure under study, based on its fundamental characteristics, procedures and requirements, to build a clear and accurate writing, which seeks to establish whether the intention of the legislator in protecting the family and its assets, covers all family units, or on the contrary, there is an express limitation for some family groups by not complying with the characteristics derived from the Colombian legal system. Now, in addition to the above, an analytical work will be carried out, of the legal figures, regulations, jurisprudence in the light of the Colombian legislation will be carried out, however, a comparative analysis will be made in the light of the Mexican and Argentinean legislation, with the purpose of establishing the concept of the institution of family at the time of constructing an attachable family patrimony.
