This article aims to reflect upon the social problem that juvenile delinquency represents nowadays and about the challenges this situation generates for the establishment of a National Juvenile Penal System, within the frame of the Children Right International Convention, which was signed by Chile in 1990. It also provides a reflection on the possibility of articulating dialogical proposals which go beyond the concept of procedural justice, and are critical to open the understanding of juvenile delin- quency toward the idea of restorative justice. In this approach, based on the relation between the young and the community, society recognises young offender as a legitimate other and allow him to repair the harm caused promoting an effective social reintegration.Este artículo reflexiona acerca del problema social que representa la delincuencia juvenil en la actualidad, y de los desafíos que ésta plantea para la institucionalización de un Sistema Nacional de Justicia Penal Adolescente, en el marco de la Convención Internacional de los Derechos del Niño suscrito por Chile en 1990. De este modo, se plantea la posibilidad de articular propuestas dialógicas que permitan trascen- der el concepto de justicia procedimental, para abrirse hacia una justicia de carácter restaurativo y de corte comunitario, donde la sociedad reconoce al joven infractor como un otro legítimo, permitiéndole la restauración del daño causado por la infracción cometida, y promoviendo con ello una reinserción social efectiva.
