Involuntary creditors in the bankruptcy law: Reflections about positive recognition in the Chilean reformed Bankruptcy Law

Abstract
In this article, the author explores the recognition and treatment in some comparative bankruptcy laws of the notion “involuntary creditors”. On this basis he analyzes its recognition in the reformed Law Nº20.720, that excludes the discharge the credits for maintenance, the obligations for economic compensation and those derived from civil and/or criminal torts, in order to address different scenarios that this regulation brings and to establish if this protection is sufficient or not. © 2023, Pontificia Universidad Catolica de Valparaiso.
