LA CORTE INTERAMERICANA DE DERECHOS HUMANOS FRENTE AL TRIBUNAL EUROPEO DE DERECHOS HUMANOS. ESTUDIO COMPARATIVO DE LA EFICACIA DE LOS FALLOS EN COLOMBIA Y ESPAÑA

Resumen
Esta investigación realizó un análisis descriptivo de derecho comparado, entre lo que sucede en el ámbito europeo con relación al cumplimiento de los fallos del Tribunal Europeo de Derechos Humanos
(TEDH), específicamente en España, y la ejecución de las Sentencias
de la Corte Interamericana de Derechos Humanos (CIDH) en Colombia. El método es bibliográfico: usa la hermenéutica como técnica y las
fichas bibliográficas como instrumento. Entre los autores citados tenemos a Amaya y Tres palacios, Guillén y Pérez. El documento contiene
dos capítulos: el primero, hace una descripción de la situación legal e
institucional que tiene el Estado colombiano para el cumplimiento de
los fallos, dictamen, o medidas cautelares de organismos internacionales en materia de Derechos Humanos; el segundo capítulo, se remite a
describir la situación del TEDH, y los efectos de sus Sentencias en los
Estados pertenecientes al Convenio Europeo de Derechos Humanos,
especialmente sobre la forma como España ha hecho frente a la problemática de cumplir con las Sentencias del TEDH cuando ha sido condenada. Finalmente, se plantean unas estrategias que pueden mejorar
la situación de cumplimiento de Colombia respecto al cumplimiento de
las Sentencias y dictámenes de organismos internacionales. This research carried out a descriptive analysis, of Comparative Law,
between what happens in the European sphere in relation to compliance
with the rulings of the European Court of Human Rights (ECHR),
specifically in Spain, and the execution of the judgments of the Inter American Court of Human Rights (IACHR) in Colombia. The method
is bibliographic: it uses hermeneutics as a technique and bibliographic
records as an instrument. Among the authors cited we have Amaya
and Tres palacios, Guillén and Pérez. The document contains two
chapters: the first one describes the legal and institutional situation
that the Colombian State has in order to comply with the rulings,
opinion, or precautionary measures of international organizations in
the field of human rights; the second chapter refers to describing the
situation of the ECHR, and the effects of its judgments in the States
belonging to the European Convention on Human Rights, especially
on the way in which Spain has dealt with the problem of complying
with the judgments of the ECHR when has been condemned. Finally,
some strategies are proposed that can improve Colombia’s compliance
situation regarding compliance with the judgments and opinions of
international organizations.
