Resumen
La presente investigación tuvo como finalidad determinar la relevancia jurídica del control a las cláusulas abusivas en los contratos de consumo y adhesión en la legislación civil peruana. Para lo cual se desarrolló una investigación jurídica de tipo teórica o dogmática, empleándose el diseño no experimental, transversal y explicativo; para lo cual se hizo uso de la técnica documental, análisis de contenido, la técnica del análisis cualitativo y la argumentación jurídica, como estrategias metodológicas en el proceso de recolección, discusión y sistematización de los datos y/o información. La investigación concluyo por reconocer que las cláusulas abusivas en los contratos de consumo y adhesión constituyen una manifestación del abuso, por ello se justifica la implementación de mecanismos de control o tutela contra las cláusula abusivas, busca evitar que mediante el empleo de contratos de consumo celebrados bajo la modalidad de adhesión, se haga uso indiscriminado de estipulaciones o cláusulas que por lo general al obedecer al designio unilateral del proveedor, conlleven inevitablemente a causar un grave perjuicio en desmedro de los consumidores, así como limitar, reducir o excluir sus derechos, o aumentando su obligaciones y cargas contractuales en contravención a la buena fe y el equilibrio contractual
