CajamarcaThe objective of the research was to determine the legal bases to considered as active and passive subjects of the crime of femicide, both men and women. To achieve this objective, a basic investigation was proposed, since it did not seek the application of the variables in reality, but was based on carrying out a theoretical-dogmatic analysis of the crime of femicide and the components of the hypothesis raised. Additionatly, the research had a qualitative approach, since statistics were not used, but only qualitative analysis was carried out, describing the characteristics of each variable. Therefore, the investigation had an explanatory scope, because it aimed to find grounds to consider, both men and women, as active and passive subjects of the crime of femicide. The grounds found are: the consideration of the terms male and female as normative elements, the violation of the principle of guilt - the proscription of crime author law and the violation of the rights to equality and identity within a Constitutional State of Law.La investigación tuvo como objetivo determinar los fundamentos jurídicos que contribuyen a considerar como sujeto activo y pasivo del delito de feminicidio, tanto al varón como a la mujer. Para llegar a dicho objetivo, se planteó una investigación de tipo básica, toda vez que no buscó la aplicación de las variables en la realidad, sino que, se basó en realizar un análisis teórico-dogmático del delito de feminicidio y de los componentes de la hipótesis planteada. También, la investigación, tuvo un carácter cualitativo, puesto que, no se utilizó la estadística, únicamente se realizó el análisis de manera cualitativa, describiendo las características de cada variable de investigación. Por último, la investigación tuvo un alcance explicativo, en razón de que buscó encontrar fundamentos que permitan considerar, tanto al varón como a la mujer, como sujetos activos y pasivos del delito de feminicidio. Los fundamentos que fueron encontrados son: la consideración de los términos varón y mujer como elementos normativos del tipo, la vulneración del principio de culpabilidad – la proscripción del derecho penal de autor; y, la vulneración de los derechos a la igualdad e identidad dentro de un Estado Constitucional de Derecho.Tesis
