Resumen
La presente investigación tuvo como objetivo proponer criterios jurídicos - económicos aplicables para una regulación económica en el sector salud a efectos de prevenir el impacto producido por la concertación de precios en un contexto de emergencia, atendiendo, a que se trata de una práctica colusoria dañina y nociva del mercado que atenta contra el derecho a la libertad de competencia, afectando directamente a los consumidores puesto que los limita a optar por diversas opciones más idóneas, beneficiosas y accesibles. Con dicho fin, se ha procedido a la recopilación de distintas fuentes normativas, doctrinarias y jurisprudenciales del Derecho Administrativo Económico nacional e internacional, acompañada del correspondiente análisis de las distintas bases teóricas y conceptuales desarrolladas a lo largo de la presente investigación. En ese sentido, fue necesario explicar el impacto de la concertación de precios en los productos del sector salud, así como analizar, desde el derecho comparado, la importancia de la regulación económica en un contexto de emergencia, para evitar excesos y abusos en los consumidores sanitarios; precisando además, que, esta investigación ha tomado por conveniente sustentar la posibilidad de una regulación económica para evitar la concertación de precios en el sector salud en un contexto de emergencia.
