Derogación del adulterio como causal de divorcio en el código civil peruano

Resumen
El divorcio es un tema importante en la realidad peruana, muchos matrimonios terminan por
distintos motivos, ya sea por la voluntad de ambos, o porque se incumplieron diferentes
obligaciones que conlleva a tener una vida en común, sabemos que el matrimonio es la voluntad
de las partes y el divorcio en muchos casos es la voluntad de los cónyuges terminar con el
matrimonio o continuar así se haya incumplido alguna obligación o deber matrimonial.
Por estas contingencias del divorcio, se ha puesto en evidencia que es un tema social y que
involucra de alguna manera a los matrimonios, es así que, el adulterio se ha vuelto un tema
trascendental por las deficiencias al momento de presentar pruebas, ya que en la doctrina peruana
se requiere que para probar el adulterio se tiene que presentar pruebas fidedignas.
Para probar la consumación del adulterio se tiene que recaer en pruebas ilícitas, las cuales son
fotos y videos que prueben el coito sexual con una persona que no sea el cónyuge, ya que se
considera que se comete adulterio cuando el cónyuge haya tenido relaciones sexuales con una
persona que no es el cónyuge matrimonial.
La mera presentación de medios de prueba ilícitas vulnera los derechos del cónyuge que comete
el adulterio tales como el derecho a la intimidad, al honor y a la dignidad, bajo este supuesto,
vemos que la persona humana es primigenia ante cualquier hecho jurídico, por ello sus derechos
no deben ser vulnerados para la disolución de un matrimonio que inició con la voluntad de las
personas y por el mismo hecho de esta voluntad, puede ser disuelto bajo cualquier otra causal, caso
contrario arribar a un divorcio convencional. Este hecho se ha visto reflejado en la realidad argentina que debieron conveniente derogar esta
norma de adulterio que vulneraba derechos y además vulneraba al buen funcionamiento y futuro
entendimiento de la familia y ex cónyuges para con sus hijos, ya que no se puede obligar a al
cónyuge prestar fidelidad, ya que este libremente a optado por un matrimonio, y respetar los
lineamientos del matrimonio debe estar regido por esta misma voluntariedad.
Para realizar y comprobar este hecho social, el trabajo de investigación utiliza una metodología
cualitativa con un enfoque descriptivo no experimental y dogmática propositiva ya que la intención
es la derogación del inciso primero del artículo 333 del código civil peruano, siendo así este, un
tema social, en pro de la sociedad conyugal. Divorce is an important issue in Peruvian reality, many marriages end for different reasons, either
by the will of both, or because different obligations that lead to having a life in common were
breached, we know that marriage is the will of the parties and divorce in many cases it is the will
of the spouses to end the marriage or continue if a marriage obligation or duty has been breached.
Due to these contingencies of divorce, it has been revealed that it is a social issue and that it
involves marriages in some way, so adultery has become a transcendental issue due to deficiencies
when presenting evidence, since in Peruvian doctrine requires that credible evidence must be
presented to prove adultery.
To prove the consummation of adultery, it is necessary to resort to illegal evidence, which are
photos and videos that prove sexual intercourse with a person other than the spouse, since adultery
is considered to be committed when the spouse has had sexual relations with a person who is not
the married spouse.
The mere presentation of unlawful means of evidence violates the rights of the spouse who
commits adultery such as the right to privacy, honor and dignity, under this assumption, we see
that the human person is primeval before any legal fact, therefore their Rights must not be violated
for the dissolution of a marriage that began with the will of the people and by the very fact of this
will, it can be dissolved under any other cause, otherwise arriving at a conventional divorce.
This fact has been reflected in the Argentine reality that this adultery norm that violated rights and
also violated the proper functioning and future understanding of the family and former spouses towards their children, should be repealed, since the spouse cannot be forced pay fidelity, since
you have freely chosen a marriage, and respect the guidelines of marriage must be governed by
this same voluntariness.
To carry out and verify this social fact, the research work uses a qualitative methodology with a
descriptive, non-experimental and dogmatic approach, since the intention is the derogation of the
first paragraph of article 333 of the Peruvian civil code, thus being a social issue. , in favor of the
conjugal society.
