Resumen
La tesis tuvo como Problema general: ¿Cómo influye el Soft Law en la
doctrina vinculante de derechos humanos en el Estado Peruano – Chanchamayo -
2020?; siendo el Objetivo general: Determinar cómo influye el Soft Law en la
doctrina vinculante de derechos humanos en el Estado Peruano – Chanchamayo -
2020. Como Supuesto general: El Soft Law influye como fuente del derecho y
técnica legislativa en la doctrina vinculante de derechos humanos en el Estado
Peruano – Chanchamayo – 2020.
La Investigación se ubicó dentro de los Métodos: análisis y síntesis,
hermenéutico y exegético; de Tipo Básico, transversal y observacional; en el Nivel
Investigación se utilizó el Descriptivo; con un Diseño de teoría fundamentada;
teniendo como población a la Doctrina Internacional y un Tipo de Muestreo
Probabilístico; Técnicas de Investigación: observación documental; con
Instrumento: de fichas de observación; Técnicas de procesamiento de datos:
contrastación de supuestos de prueba dicotómica; llegándose a la conclusión: El
Soft Law, no está siendo usado de forma obligatoria y adaptándose dentro de la
normativa de cada Estado para su aplicación, con lo cual no pueden considerarse
como fuentes formales de derecho y en consecuencia, carecen de fuerza obligatoria,
sin embargo, no parecen ser directas sobre la formación del derecho, aunque
generalmente aparecen a través de las fuentes tradicionales, a saber, tratados,
derecho consuetudinario o principios generales. Además, el Soft Law es importante
para la jurisprudencia del Tribunal Constitucional en cuanto a su aplicación en casos
jurídicos, al igual que para el Ministerio de Justicia y la Corte Suprema de Justicia.
