Resumen
En Perú, gran parte de los contratos y expedientes técnicos originales para obras públicas se ven modificados durante la ejecución de la obra. El problema radica en factores de estimación (deficiencias no advertidas en el expediente técnico) y/o eventos naturales o antropogénicos no previstos posteriores a la suscripción del contrato. Estas situaciones son un obstáculo para el cumplimiento de la meta prevista de la obra principal. En la búsqueda oportuna de una solución eficiente frente a esta necesidad, se generan las prestaciones adicionales de obra, cuya valoración -técnica, económica y legal- debe ser aprobada por la Entidad, o autorizada por la Contraloría General de la República (CGR).
No obstante, las acciones de control realizadas por los Órganos de Control Institucional de entidades públicas y la CGR, han determinado riesgos y desviaciones en la aprobación de adicionales, lo que ha resultado en sanciones administrativas funcionales, civiles y hasta penales, en contra de los responsables de estas aprobaciones, es decir, funcionarios y profesionales de la ingeniería civil que no repararon en valorar los adicionales correctamente, transgrediendo la Ley y perjudicando también económicamente al Estado. A fin de evitar los riesgos provenientes de los adicionales de obra en la Región Lambayeque, se ha realizado un diagnóstico inédito de la realidad local durante el periodo 2014-2018, determinando que los montos contractuales de obra se han incrementado en promedio un 4.24%, lo que significa el pago de adicionales por S/ 14,187,796.85. Se han propuesto recomendaciones transcendentales y mecanismos de reforma, para evitar estos riesgos y mejorar el sistema de gestión pública.
