Autonomía de actos y derechos comunales y el fortalecimiento del rol de la mujer bajo la aplicación de la Ley n.º 30982 sobre nombramiento de directivas comunales en el registro de personas jurídicas de la Zona Registral N.º X – Sede Cusco, 2020-2021

Resumen
La promulgación de la Ley N° 30982 que modifica la Ley N° 24656, Ley General de
Comunidades Campesinas, para fortalecer la participación de la mujer en las directivas
comunales dio lugar a nuevas interpretaciones en la calificación registral de los
nombramientos y/o renovaciones de las directivas comunales dentro de los Registros Públicos
por no cumplir con el 30% de mujeres o varones establecido por Ley.
Resultó necesario analizar los fundamentos jurídicos, sociales y fácticos que justificaron la
regulación de la composición mixta para las directivas comunales en la Zona Registral N° X
– Sede Cusco, dando como resultado una investigación con un alto valor teórico a través de
un enfoque cualitativo con el estudio de documentos, análisis de las normas y entrevistas a
profesionales expertos en comunidades.
Por ello, consideramos que se deben establecer nuevas medidas legales a fin de garantizar la
inscripción de la composición mixta en los Registros Públicos y poner fin a la discriminación
de género en las comunidades campesinas del Perú adecuando el derecho de igualdad de
género e igualdad de oportunidades a la conformación de las listas de candidatos para la
elección de la directiva comunal que resulte ganadora en las elecciones comunales. The promulgation of Law No. 30982 that modifies Law No. 24656, General Law of Peasant
Communities, to strengthen the participation of women in community boards, gave rise to
new interpretations in the registration qualification of appointments and/or renewals of the
communal directives within the Public Registries for not complying with the 30% of women
or men established by Law.
It was necessary to analyze the legal, social and factual foundations that justified the
regulation of the mixed composition for the communal directives in the Registry Zone No. X
- Cusco Headquarters, resulting in an investigation with a high theoretical value through a
qualitative approach with the study of documents, analysis of the norms and interviews with
professional experts in communities.
For this reason, we consider that new legal measures should be established in order to
guarantee the registration of the mixed composition in the Public Registries and put an end to
gender discrimination in the peasant communities of Peru, adapting the right to gender
equality and equal opportunities. to the conformation of the lists of candidates for the election
of the communal board that is the winner in the communal elections.
