Eficacia de los órganos jurisdiccionales frente a prescripciones por faltas contra la persona, juzgados de paz letrado de Tarapoto, 2021

Abstract

La presente investigación tiene como título eficacia de los órganos jurisdiccionales frente a prescripciones por faltas contra la persona, juzgados de paz letrado de Tarapoto, 2021, donde se tuvo como objetivo general Determinar el nivel de eficacia de los órganos jurisdiccionales frente a prescripciones por faltas contra la persona, juzgados de paz letrado de Tarapoto, 2021, seguidamente y para complementarse ha establecido como objetivos específicos en Identificar las dimensiones de los órganos jurisdiccionales en todos sus extremos, reconocer las dimensiones de prescripción por faltas contra la persona en los juzgados de paz letrado de Tarapoto, 2021 y conocer los factores de prescripción por faltas contra la persona en los juzgados de paz letrado de Tarapoto, 2021. La investigación fue de tipo aplicada, con un enfoque cuantitativo, nivel descriptivo simple, teniendo como instrumento principal la encuesta que fue a 50 servidores judiciales entre ellos jueces, servidores judiciales y usuarios de los servicios jurídicos del Poder Judicial, siguiendo esa línea y para reforzar se ha analizado la consecución de 31 expedientes judiciales recaídos en los procesos por faltas contra la persona donde se han emitido las resoluciones de prescripción, para ellos se ha utilizado la guía de análisis documental. Como resultado de la aplicación de la encuesta se pudo identificar que el 60.00% manifiesta que, si existe afectación, por su parte del análisis de los expedientes en procesos por faltas contra la persona se podido encontrar factores internos y externos que fueron determinantes para la emisión de las resoluciones de prescripción, por lo que se concluye que el nivel de eficacia de los órganos jurisdiccionales frente a prescripciones por faltas contra la persona, juzgados de paz letrado de Tarapoto, 2021 es alta en un 72%, debido a la prueba de normalidad aplicada a las variables, donde se obtuvo un p. valor es de 0.000 que son menores a Alpha (0.05), lo cual indica que los datos de las variables estudiadas siguen una distribución normal, aceptándose la hipótesis.

The present research is entitled "Effectiveness of the jurisdictional bodies against statutes of limitations for misdemeanors against the person, Magistrates' Courts of Tarapoto, 2021", where the general objective was to determine the level of effectiveness of the jurisdictional bodies against statutes of limitations for misdemeanors against the person, Magistrates' Courts of Tarapoto, 2021. Subsequently, to complement the above, the following specific objectives have been established: to identify the dimensions of the jurisdictional bodies in all their extremes, to recognize the dimensions of the statute of limitations for misdemeanors against the person in the Magistrates' Courts of Tarapoto, 2021 and to determine the factors of the statute of limitations for misdemeanors against the person in the Magistrates' Courts of Tarapoto, 2021. This was an applied research, with a quantitative approach, simple descriptive level, having as main instrument the survey of 50 judicial employees, including judges, judicial officers and users of the legal services of the Courts, following this line and to reinforce the achievement of 31 judicial records of the proceedings for misdemeanors against the person where the resolutions of prescription have been issued, for them the documentary analysis guide has been used. The survey results showed that 60.00% of the respondents stated that they were affected, while the analysis of the files in proceedings for misdemeanors against the person revealed internal and external factors that were determinant for the issuance of the statute of limitations resolutions. It is concluded that the level of effectiveness of the jurisdictional bodies in dealing with statutes of limitations for offenses against the person, Tarapoto Magistrates' Courts, 2021 is high at 72%, due to the normality test applied to the variables, where a p. value of 0.000 was obtained, which is less than Alpha (0.05), indicating that the data of the variables under study follow a normal distribution, thus accepting the hypothesis.
