El delito de usurpación y la antijurídicidad

En el presente se hace un análisis, basado en un expediente penal, sobre el delito contra el patrimonio en su modalidad de usurpación, delito regulado y sancionado en artículo 202° y 204° del Código Penal Peruano, en donde se entiende que para comisión de este delito el agente debe actuar en contra o sobre los bienes inmueble ajenos; diferenciándolo de esta manera de otros delitos contra el patrimonio. En ese entender en el mismo se desarrolla un análisis constitucional, legal, doctrinal y jurisprudencial sobre el delito de usurpación solo en relación al caso concreto, despojo de la posesión mediante violencia y con la intervención de dos o más agentes.
