Resumen
En la actualidad se ha visto que los trabajadores tanto en el sector Público como en el Privado, que
ingresen a laborar en cargos calificados como de confianza o a ejercer funciones de la misma
naturaleza, no necesitan la existencia de una “causa justa de despido”, sino que basta alegar el
“retiro” o la “perdida” de confianza. Basta, entonces, la decisión unilateral del empleador, basada
en su apreciación subjetiva, para que se conforme una razón suficiente para terminación del
contrato de trabajo.
Sin embargo se ha contemplado que existe una falta de regulación en cuanto a la extinción de la
relación laboral de los trabajadores de confianza del Sector Privado, y por lo cual, consideramos
que la solución al problema identificado es una propuesta normativa.
Es por ello que frente a esta dificultad, y una vez analizada la respectiva jurisprudencia y doctrina,
hemos precisado que no debería ser factible que el despido por retiro de confianza, de lugar al pago
de una indemnización por despido arbitrario; puesto que ello tendría como consecuencia que el
acto de celebración del contrato de trabajo para ejercer cargos de confianza contenga tácitamente
una cláusula de “indemnización por despido arbitrario”, toda vez que siempre que cese el
trabajador, sea cual fuera la causa, incluyendo el retiro de confianza, tendría que ser indemnizado
por ser arbitrario dicho cese, lo cual resulta inconsistente.
Por lo tanto concluimos que “La pérdida de la confianza constituye una causa justa de despido;
conllevando a la extinción de la relación laboral de los Trabajadores de Confianza, siempre que
estos hayan accedido a estos puestos desde el inicio de la relación laboral, de lo contrario, el
Trabajador de Confianza despedido que haya sido promovido a dicho puesto habiendo ocupando
antes un puesto común, deberá retornar a su puesto originario”.
