El debido procedimiento en el proceso administrativo disciplinario para los docentes de la Ugel- La Libertad, 2019-2020.

Abstract

El presente trabajo de investigación busca dar a conocer la problemática del Proceso Administrativo Disciplinario en los docentes de las Ugeles de la Libertad, toda vez que actualmente, se ha detectado una serie de nulidades e irregularidades que atentan contra las garantías del derecho al debido proceso, expresado en el ámbito del derecho administrativo como el debido procedimiento. En este panorama, el problema radica en determinar en qué supuestos se vulnera el derecho al debido procedimiento y con ello la nulidad del procedimiento administrativo disciplinario. De igual manera, hemos realizado un estudio del derecho al debido proceso que se aplica al ámbito del derecho administrativo, como es el caso del debido procedimiento administrativo. Finalmente, hemos realizado un análisis de las resoluciones emitidas por la Primera y segunda Sala del Tribunal del Servicio Civil del año 2019- 2020, en las cuales se ha detectado que las Comisiones Permanentes del proceso Administrativo disciplinario han incurrido en diversos supuestos que vulneran el derecho al debido procedimiento en sede administrativa.

ABSTRACT The present research work aims to demonstrate the problems of the Administrative Disciplinary Process of sanctioning teachers of the UGELL of La Libertad, since at present the mentioned procedure has relapsed in nullities that violate the guarantees of the right to due process, expressed in the field of administrative law as due process. In this sense, the problem chosen for research is to determine in which cases the guarantee of due process is violated and thus the nullity of the administrative disciplinary sanctioning procedure. Likewise, we have carried out a study of the guarantee of due process that applies to the field of administrative law as the due administrative procedure. Finally, we have conducted an analysis of the resolutions issued by the First and Second Chambers of the Civil Service Tribunal of the year 2019- 2020, in which it has been evidenced that the Permanent Commissions of the Administrative disciplinary process have incurred in various assumptions that violate the guarantee of due process.
