Repercusión en el derecho a la vida en Perú en la jurisprudencia constitucional y resolución del ministerio de salud respecto a la píldora del día siguiente

Al haberse expedido en Perú dos resoluciones cuyos contenidos son contradictorios respecto al derecho constitucional a la vida, una Resolución N° 399-2001-SA/DM expedida por el Ministerio de Salud y la Resolución N° 02005-2009-PA/TC del Tribunal Constitucional Peruano fue de interés investigar la repercusión tanto en el ámbito jurídico como en lo social. Para demostrar ello, se procedió a tomar información sobre dichas Resoluciones, que han constituido el material de estudio, para lo cual fue de utilidad el método analítico-sintético para identificar los aspectos contradictorios de ambos instrumentos legales dirigidos al derecho a la vida del concebido. Los datos se presentan en una tabla comparativa, en la que se resalta la autorización del Ministerio de Salud para distribuir la píldora oral de emergencia y el fallo del Tribunal Constitucional, en la que se prohíbe su distribución gratuita. Se infiere del análisis respectivo que ambas resoluciones afectan el orden jurídico peruano, por un lado se permite el uso y por otro lado se prohíbe su distribución gratuita, sin emitir pronunciamiento de fondo, al no indicar que es píldora abortiva, de esta manera el derecho del concebido pasa a un plano intermediado por el mercado y la dualidad jurídica.
