El presente trabajo de investigación titulado: ““El Recurso de Casación
y la garantía del derecho a un recurso amplio en los casos de Condena
del Absuelto en el Código Procesal Penal de 2004”, aborda la
problemática respecto a la Condena del Absuelto, regulada en los
artículos 419, inc.2 y 425, inc.3 literal b.
El problema que se ha planteado es determinar si el Recurso de
Casación es la vía idónea para garantizar el derecho a un recurso
amplio en los casos de Condena del Absuelto, en el Nuevo Código
Procesal Peruano en los años 2012 a 2017 y a fin de contrastar la
hipótesis se ha desarrollado dentro del marco teórico temáticas como,
la teoría de la impugnación, la tutela judicial efectiva, el recurso de
apelación y recurso de casación, etc. Así también se hizo uso del
método Inductivo – Deductivo, Comparativo, analítico-sintético, en el
análisis de los casos que han sido materia de estudio.
Esta investigación ha concluido principalmente que el recurso de
casación no es la vía más idónea para garantizar el derecho a un
recurso más amplio en caso de condena al absuelto; pues este recurso
por ser extraordinario, limitado e ineficiente, no permite una adecuada
revisión de la condena en segunda instancia, puesto que el condenado
no podrá pedir la revisión de la errónea valoración de las circunstancias
fácticas y probatorias de la sentencia condenatoria de segunda instancia, como si lo tiene el condenado en primera instancia, cuestión
que importa un recorte de garantías esenciales del debido proceso.
