Los órganos colegiados: impacto en la gestión de la administración pùblica local

La presente investigación, sobre la Organización y Funcionamiento de los Órganos Colegiados y su impacto, en la eficiencia, calidad y transparencia de la gestión pública, se inicia con el estudio del Decreto Supremo N° 006-67-SC, que determina la separación de la actividad administrativa, del control civil y se consolida con la Ley 27444, que establece la autonomía dogmática y normativa del procedimiento administrativo del proceso civil. También se estudia la temática de la Administración Publica, del Acto Administrativo, del Derecho de la Organización: y dentro de ésta del Instituto de la Disensión Orgánica, para ubicar con toda precisión la naturaleza jurídica de los órganos colegiados. Se estudia las 5 fases o etapas, que determinan el nacimiento del acto colegial: 1) Nombramiento; 2) Convocatoria; 3) Quórum; 4) Deliberación y 5) Votación, en la Ley 27444, TUO: D.S. N° 006-2017-JUS. Se precisa por último, que los Órganos Colegiados promueven una gestión pública más democrática y transparente, exigiendo a sus integrantes tener plena conciencia de lo que van a decidir, cuando determina la obligatoriedad del voto, dentro de la estructura de los órganos colegiados, protegiendo la legalidad, una gestión pública más participativa y transparente, así como los Derechos de los Administrados. Las conclusiones, han surgido previo uso de los métodos Inductivo – deductivo; analítico, sintético y jurídico. La aplicación de dogmática y normativa de los órganos colegiados en la Municipalidad de Carabamba, está dentro de los márgenes aceptables.
