La presente tesis titulada: “El derecho fundamental del acceso a la justicia y las barreras de acceso en poblaciones urbanas pobres dentro de la ciudad de Trujillo”aborda la problemática respecto a si está suficientemente protegido el derecho de acceso a la justicia de las personas residentes en zonas urbanas pobres.
Para formular y contrastar nuestra hipótesis, que “El derecho del acceso a la justicia para personas residentes en zonas urbanas pobres en la ciudad de Trujillo no está debidamente protegido toda vez que existen problemas y barreras sociales y económicas que le imposibilitan tener acceso a una debida protección judicial” se ha utilizado desarrollado en el Marco Teórico, temáticas como acceso a la justicia, supuestos para garantizar el acceso a la justicia y del debido proceso, los principios integrantes del debido proceso, las garantías judiciales del debido proceso, las comunidades urbanas pobres y los aranceles judiciales, así también se hizo uso del método Inductivo – Deductivo, Comparativo, Hermenéutico, Etnográfico, así como el uso de encuestas y entrevistas a operarios del poder judicial.
Esta investigación ha concluido que las personas residentes en zonas urbanas pobres no ven suficientemente protegido su derecho del acceso a la justicia, toda vez que aún existen problemas y barreras que le imposibilitan hacer uso completo de su derecho a recurrir a la vía jurisdiccional
