Vulneración de los artículos 74º y 104º de la Constitución Política del Perú por la aplicación de la ley N.º 30506

Resumen
La presente investigación tiene como objetivo general analizar de qué manera se vulneran los artículos 74º y 104º de la Constitución Política del Perú por la aplicación de la Ley N.º 30506. Se utilizó una metodología de tipo cualitativo y de diseño explicativa, donde la muestra estuvo conformada por material jurídico y fuentes documentales (normas, expedientes, resoluciones, libros, revistas, y jurisprudencia) en torno a los artículos 74º y 104º de la Constitución y la Ley N° 30506, así como por 5 abogados especialistas en Derecho Tributario de la ciudad de Trujillo, a quienes se aplicó una guía de entrevista. Se concluye que, se vulneran los artículos 74º y 104º de la Constitución Política del Perú por la aplicación de la Ley N.º 30506, al producirse una afectación al principio de Constitucionalidad, al principio de Reserva de la Ley y la Potestad Tributaria del Estado, en vista a que, tanto la Constitución, Reglamento del Congreso y la Ley Orgánica del Poder Ejecutivo, tienen una forma genérica e ilimitada respecto de la delegación de facultades legislativas al Poder Ejecutivo, la cual no tiene carácter excepcional o extraordinario, además que, la labor de control parlamentario implica una toma de conocimiento a posteriori, lo que no constituyen propiamente un mecanismo de control. Aunado a ello, se obtuvo que, no se establecen parámetros jurídicos para regular el otorgamiento de facultades legislativas al Poder Ejecutivo en el Derecho Peruano.
