Inaplicabilidad de la Ley de Contumacia como causal de suspensión de la prescripción en el proceso penal del adolescente

Resumen
El presente trabajo tuvo como objetivo indagar en la jurisprudencia nacional, los criterios deaplicación de la Ley de Contumacia como causal de suspensión de la prescripción en elproceso penal del adolescente infractor, obteniéndose como resultado la identificación de lossiguientes criterios: a) La complejidad del caso, b) la actividad procesal del interesado, y c)la actuación del órgano jurisdiccional; los cuales fueron recogidos de la jurisprudencia sobre
la determinación del plazo razonable del proceso. En tal sentido, la medida legislativacontenida en el artículo 1° de la Ley de Contumacia, es aplicable en tanto se verifique algunade las mencionadas reglas o criterios. Así, entonces, la aplicación de dicha medida, no supone
una afectación al principio del Interés Superior del Niño, el cual, en todo momento, viene aser de estricta observancia por parte de los órganos jurisdiccionales a cargo de dichosprocesos, en razón al rango constitucional y convencional que el mismo ostenta. Finalmente,
se formuló una propuesta de lege ferenda, con el propósito de modificar la disposicióncontenida en artículo 74° numeral 4 del Código de Responsabilidad Penal de Adolescentes,a fin que en dicho articulado se regule expresamente la Ley N° 26641 – Ley de Contumaciacomo causal de suspensión del plazo prescriptorio. The objective of this work was to investigate, in national jurisprudence, the criteria for applying the Law of Default as a cause for suspension of the prescription in the criminal process of the adolescent offender, resulting in the identification of the following criteria: a) Complexity of the case, b) the procedural activity of the interested party, and c) the actions of the jurisdictional body; which were collected from the jurisprudence on the determination
of the reasonable period of the process. In this sense, the legislative measure ontained in article 1 of the Default Law is applicable as long as any of the aforementioned rules or criteria are verified. Thus, then, the application of said measure does not imply an impact on the principle of the Best Interest of the Child, which, at all times, must be strictly observed by the jurisdictional bodies in charge of said processes, due to the constitutional and conventional rank that it holds. Finally, a lege ferenda proposal was formulated, with the
purpose of modifying the provision contained in article 74, numeral 4 of the Code of Criminal Responsibility for Adolescents, so that said article expressly regulates Law No. 26641 – Law of Contumacia as a cause for suspension of the prescriptive period.
