CULPA IN CONTRAHENDO IN MORTGAGE LOAN

Abstract

We will analyze a final judgment in a precontractual liability case about a mortgage loan not granted by a bank. This commentary will make a critical analysis of various legal rules. All in order to determine if in this case did exist or not agreement that usually proved by showing an offer by one party and acceptance of it by the other, and how this interpretation may change with the new rules of consumer's law introduced recently.
