La eficacia normativa y administrativa en la lucha contra la piratería fonográfica en el Perú

La piratería se considera como aquella actividad delictiva en que consiste en la reproducción
¡legal, no autorizada por parte del autor. Además comúnmente se le denomina piratería, porque
cuyos delincuentes, que vienen ser bucaneros modernos, que se apropian ¡lícitamente del
patrimonio ajeno, copiando o reproduciendo obras literarias o artísticas sin autorización, y
perjudicando a los titulares de los derechos de autor
La piratería es un problema que genera pérdidas económicas a las compañías discográficas, a
los estudios de grabación y a las tiendas de discos, esto no solo afecta a ellos sino también a
sujetos que pueden estar destinados a tener un desempleo como: los productores de
fonogramas, los cantantes, los compositores, a los arreglistas musicales, a los mezcladores de
sonido, a los grafistas, a los que realizan la comercialización legal, la promoción y la publicidad
del disco, los fabricantes, y a las tiendas de discos, que esto da como consecuencia que cada vez
se extinga un arte como la música.
Gracias a la aparición de la tecnología la piratería ha evolucionado cuando ha aparecido otra
forma de obtener música que es a través de descargas directas por internet, esto provoca que
haya más piratería.
En nuestro país existen mecanismos legales para combatir la piratería, pero no cuenta con una
eficacia normativa para resolver este problema.
El estado debe hacer una buena coordinación por parte de las entidades que se encargan en
proteger los derechos de autor.
Entre la legislación nacional y las legislaciones extranjeras existe una semejanza con respecto a
la normatividad de las sanciones por ejemplo: entre Perú, China y México existe la sanción de la
multa, y entre Perú y Estados Unidos la sanción de la Incautación.
