Resumen
La presente tesis titulada “Ausencia de criterios de evaluación de la reparación civil
en sentencias absolutorias y la tutela jurisdiccional efectiva de los agraviados”, tiene
como problema de investigación: ¿De qué manera la ausencia de criterios de
evaluación de la reparación civil en sentencias absolutorias vulnera la tutela
jurisdiccional efectiva de los agraviados?; así mismo se planteó como objetivo
general: Determinar de qué manera la ausencia de criterios para la evaluación de
la reparación civil en sentencias absolutorias vulnera la tutela jurisdiccional efectiva
de los agraviados; el tipo de investigación fue básica, porque el principal objetivo
es obtener nuevos conocimientos con un enfoque de investigación cualitativa,
debido a que se estudia conforme a la realidad, analizando los sucesos que se
manifiestan; su diseño es exploratorio, con objetivo general y específico. En cuanto
a la recolección de información se ha utilizado la técnica de revisión documentaria,
esto es, el estudio de teorías y diversos materiales bibliográficos, entre éstos
encontrándose casaciones nacionales, así mismo aplicamos la técnica de la
entrevista, haciendo uso del instrumento de la guía de entrevistas a profundidad
todo ello con la finalidad de cumplir nuestros objetivos. Los resultados de la
investigación revelaron el escaso y/o nulo pronunciamiento de los operadores de
justicia respecto de la imposición de reparación civil al imputado absuelto o
sobreseído en el proceso penal, a consecuencia de la inexistencia de criterios para
la evaluación de la reparación civil, en estos casos, produciendo así una
vulneración a la tutela jurisdiccional efectiva del agraviado propiamente dicho.
