El presente estudio se fundamentó en el análisis para garantizar la credibilidad del cheque, orientado a incentivar en el sector empresarial del país, la confianza que este título valor ha perdido al no tener un tipo penal especifico que castigue el libramiento de cheques sin fondo. Lo anterior considerando que el área comercial del país, esto es, aquellos que utilizan mayormente el cheque como método unitario de pago, coinciden en la no aceptación del mismo, ante la falta de seguridad jurídica que implica su utilización. El presente documento define el sentir y pensar de la población mercantil en particular y del sector judicial (Tribunales-Juzgados y Abogados Particulares) en general, ya que a pesar que se tienen métodos para hacer valer el derecho que en los cheques se consigna, en ocasiones en la práctica es imposible ejercitar la acción penalThis study is based on the analysis to ensure the credibility of the check, aimed at encouraging the corporate sector lost confidence in it, by the lack of a specific type of offense that will punish the emission of a bad check.
