El delito de prevaricato judicial en el derecho penal colombiano

El presente trabajo de fin de grado se centra en la delimitación delito de prevaricato “judicial” en el contexto del sistema penal colombiano, analizando sus características básico-estructurales y la importancia de la “finalidad corrupta”, el juicio de acierto y legalidad en la adecuación típica de esta conducta. En este contexto, cobran especial importancia la decisión manifiestamente contraria a la ley y los elementos básico-estructurales no explícitos en el tipo penal. Para ello se optó por una investigación de tipo cualitativo, empleando una metodología de corte bibliográfico documental sistemática y exhaustiva para el análisis documental existente sobre el tema. Como resultados de la investigación, se encontró que, dada la naturaleza de la “finalidad corrupta” como un elemento non criminall, el prevaricato “judicial” recibe el tratamiento de tipo penal en blanco, lo que significa que su comprensión requiere la remisión al orden normativo non criminall. Además, la distinción entre juicio de legalidad y juicio de acierto al proferir decisiones judiciales es esencial para determinar la contradicción manifiesta. Por ello, la “finalidad corrupta”, la contradicción manifiesta de la ley y la delimitación entre juicio de legalidad y acierto son conceptos centrales para su comprensión y su aplicación en la dogmática jurídico-penal. This paper focuses on the delimitation of the crime of “judicial” prevarication in the context of the Colombian criminal system, analyzing its basic-structural characteristics and the importance of the “corrupt intent”, the judgment of good aim and legality in the typical adequacy of this conduct. In this context, the decision between decisions manifestly contrary to the law and the basic-structural elements not explicit in the criminal type take on special importance. For this purpose, a qualitative type of research was chosen, using a systematic and exhaustive documentary bibliographic methodology for the existing documentary analysis on the subject. As a result of the research, it was found that, given the nature of the “corrupt intent” as an non criminall element, the “judicial” prevarication is treated as a blank criminal type, which means that its understanding requires referral to the non criminall normative order. In addition, the distinction between the judgment of legality and the judgment of good aim in rendering judicial decisions is essential to determine the manifest contradiction. Therefore, the “corrupt intent”, the manifest contradiction of the law and the delimitation between legality and good aim are key concepts for its understanding and application in criminal-legal dogmatics.
