Assim, o presente trabalho estuda o
This research seeks to highlight the collision of fundamental rights present in
Vaquejada, a sports practice that uses animals, and possibly deduce which should
prevail, discussing its cultural and environmental aspects, and discussing the
fundamentals of the Right to Environment and the Right to Culture. It intends to analyze
the constitutionality of Constitutional Amendment No. 96/17, the possible existence of
the backlash effect on the matter, and the feasibility of the environment being
considered a stony clause. Thus, the present work studies the Right to Environment
and the Right to Culture, analyzing them as fundamental rights from the perspective of
the Federal Constitution of 1988, and the way they impact the theme of vaquejada, in
light of the constitutionality of this practice. After analyzing the constitutional aspects,
it is possible to understand that, although the vaquejada has notable cultural relevance,
it is inadmissible that such practice infringes the Right to a safe and balanced
environment, an essential aspect for a dignified existence.
