A prisão no tribunal do júri como ofensa ao duplo grau de jurisdição

O trabalho consiste em uma análise se a prisão no tribunal do júri após condenação do conselho de sentença ofende o duplo grau de jurisdição. Desse modo, buscamos utilizar o método de pesquisa exploratória e descritiva, analisando os dados que foram coletados por meio de pesquisa bibliográfica e estudo de caso. Foram analisados artigos científicos, livros e normas constitucionais, assim como posicionamento de juristas. Assim, buscamos descrever todo processo punitivo do Estado, desde sua origem até os dias atuais na tentativa de contextualizar a discussão. Em seguida, foi uma apresentada a discussão em relação ao tema e demonstrada seus pontos de vista sobre o início imediato do cumprimento da pena após sentença do tribunal do júri. Demonstramos que o assunto é complexo e permite mais de uma interpretação e que sem um posicionamento coerente e assertivo da suprema corte, permanecerá um vácuo e aumentará o descontentamento do judiciário perante a sociedade. The work consists of an analysis of the arrest in the court of the jury after condemnation of the sentencing council offending the double degree of jurisdiction. In this way, we seek to use the exploratory and descriptive research method, analyzing the data that were collected through bibliographical research and case study. Scientific articles, books and constitutional norms were analyzed, as well as the position of jurists. Thus, we seek to describe the entire punitive process of the State, from its origin to the present day to contextualize the discussion. Then, there was a presentation to discuss the topic and demonstrate their views on the beginning of serving the sentence after the sentence of the jury court. We demonstrate that the subject is complex and allows more than one interpretation and that without a coherent and assertive position of the supreme court, maintaining a vacuum and increasing the discontent of the judiciary before society.
