COMISSÃO PARLAMENTAR DE INQUÉRITO MUNICIPAL: Poderes e Limitações dos Membros do Poder Legislativo Municipal, nas Atividades de Controle Parlamentar

Uma Comissão Parlamentar de Inquérito (CPI) é um órgão próprio do Poder
Legislativo, instituído especial ou permanentemente, com os poderes de
investigação similares aos judiciários, a fim de apurar, por prazo certo; fato ou fatos
determinados, ligados a irregularidades, ilegalidades ou má gestão da coisa pública
por seus administradores; podendo encaminhar as suas apurações ao Ministério
Público, para que se promova a responsabilidade civil ou criminal dos infratores.
Com a relação à possibilidade de instauração de uma CPI, no âmbito do legislativo
municipal não há, na doutrina, maiores discussões, considerando-se que a
fiscalização do Poder Executivo é uma das atribuições do Poder Legislativo, em
todos os entes federativos. Nesse aspecto, a possibilidade de ser incluída nas Leis
Orgânicas Municipais, existe mandamento constitucional expresso que diz: “Art.29,
inciso XI. Organização das funções legislativas e fiscalizadoras da Câmara
Municipal”. É necessário enfatizar que, sem causar prejuízo às demais funções
exercidas pelo Poder Legislativo Municipais, as funções de controle ou investigação
dos atos do Executivo; bem como de toda a administração pública municipal, ou
ainda do setor privado local, desde que tenha influência direta ou indireta no
interesse público, devem ser fiscalizadas, com a finalidade de apurar quaisquer tipos
de irregularidades. A investigação parlamentar, quando realizada em âmbito
municipal, demonstra ser mais eficaz, visto que é realizada por meio de instrumentos
mais ágeis, citando aqui monções, indicações, requerimentos, pedidos de
informações e tomadas de conta. O presente estudo teve por objetivos, realizar uma
revisão de artigos científicos publicados em periódicos nacionais no período de 1988
a 2021, sobre as Comissões Parlamentares de Inquérito, em âmbito municipal e
uma breve análise sobre poderes e limitações dos membros do poder legislativo
municipal, nas atividades de controle parlamentar. O trabalho possui o formato de
revisão bibliográfica, com buscas realizadas buscas em bases de dados, através dos
descritores em português: Comissão Parlamentar de Inquérito e Poder Legislativo
Municipal. Para a pesquisa foram aceitos estudos, escritos apenas em língua
portuguesa, que abordaram os descritores mencionados. Como critério de exclusão,
artigos fora dos termos selecionados e idioma estipulado, foram descartados. Ao
término, do presente estudo, pode-se constatar que uma CPI é um órgão próprio do
Poder Legislativo, instituído especial ou permanentemente, com os poderes de
investigação similares aos judiciários, a fim de apurar, por prazo certo; fato ou fatos
determinados, ligados a irregularidades, ilegalidades ou má gestão da coisa pública
por seus administradores; podendo encaminhar as suas apurações ao Ministério
Público, para que se promova a responsabilidade civil ou criminal dos infratores.
Cada poder legislativo só pode instalar uma CPI para investigar o Executivo
correspondente a ela. Ou seja, câmaras municipais investigam executivos
municipais; as assembleias, os executivos estaduais; e a Câmara e Senado o
Executivo federal. Até o prazo final previsto, o relator apresentará o relatório final.
Para ser aprovado, deverá receber o voto favorável da maioria dos membros da CPI,
que enviará o relatório final aprovado à Mesa, para conhecimento e providências do
Plenário. A Parliamentary Commission of Inquiry (CPI) is an organ of the Legislative Power,
specially or permanently instituted, with powers of investigation similar to those of the
judiciary, in order to investigate, for a certain period; determined fact or facts, linked
to irregularities, illegalities or mismanagement of public affairs by its administrators;
may forward their findings to the Public Prosecutor's Office, so that the civil or
criminal liability of the offenders is promoted. With regard to the possibility of
establishing a CPI, within the ambit of the municipal legislature, there are no major
discussions in doctrine, considering that the supervision of the Executive Branch is
one of the attributions of the Legislative Branch, in all federative entities. In this
aspect, the possibility of being included in the Municipal Organic Laws, there is an
express constitutional commandment that says: “Art.29, item XI. Organization of the
legislative and supervisory functions of the City Council”. It is necessary to
emphasize that, without prejudice to the other functions exercised by the Municipal
Legislative Power, the functions of control or investigation of the acts of the
Executive; as well as the entire municipal public administration, or even the local
private sector, as long as it has direct or indirect influence in the public interest, must
be inspected, with the purpose of investigating any types of irregularities.
Parliamentary investigation, when carried out at the municipal level, proves to be
more effective, since it is carried out by means of more agile instruments, citing
monsoons, indications, requirements, requests for information and accountability.
The present study aimed to carry out a review of scientific articles published in
national journals in the period from 1988 to 2021, on the Parliamentary Commissions
of Inquiry, at the municipal level and a brief analysis on the powers and limitations of
the members of the municipal legislative power, in the parliamentary control
activities. The work has the format of a bibliographic review, with searches carried
out in databases, through the descriptors in Portuguese: Parliamentary Commission
of Inquiry and Municipal Legislative Power. For the research, studies were accepted,
written only in Portuguese, which addressed the mentioned descriptors. As an
exclusion criterion, articles outside the selected terms and stipulated language were
discarded. At the end of this study, it can be seen that a CPI is an organ of the
Legislative Power, specially or permanently instituted, with powers of investigation
similar to the judiciary, in order to determine, for a certain period; determined fact or
facts, linked to irregularities, illegalities or mismanagement of public affairs by its
administrators; they may forward their investigations to the Public Prosecutor's
Office, so that the offenders are held civil or criminally liable. That is, city councils
investigate city executives; the assemblies, the state executives; and the House and
Senate the federal Executive. By the deadline set, the rapporteur will present the final
report. To be approved, it must receive the favorable vote of the majority of the
members of the CPI, who will send the approved final report to the Board, for
knowledge and action by the Plenary.
