A Privatização do Sistema Prisional tem gerado grandes discussões e posições doutrinárias controversas. É cediço que a malha carcerária brasileira vivencia um caos estrutural. Portanto, muito se discute sobre as alternativas ou possibilidades para a resolução deste problema, por exemplo, a privatização. Por isso, este trabalho tem como objetivo analisar os aspectos da privatização do sistema penitenciário, buscando identificar se esta é a melhor solução para a melhoria da atual precarização carcerária, ou seria a legalização da mercantilização da execução penal através da abordagem dos aspectos positivos e negativos e da análise da inconstitucionalidade da privatização e a constitucionalidade das concessões. Em um segundo plano, analisar um dos modelos de “privatização” com enfoque nos aspectos legais da implantação das chamadas parcerias público-privadas no sistema prisional, uma vez que se discute sobre os limites gerais da ingerência dos presídios, bem como quais seriam as vantagens e desvantagens desta ingerência na administração do sistema prisional, trazendo ao corpo do trabalho apontamentos sobre o Complexo Prisional de Ribeirão das Neves em Minas Gerais. A metodologia utilizada foi a documental bibliográfica, por meio do método analítico, com o estudo de artigos científicos, doutrinas, legislação pertinente ao tema e livros, para demonstrar que, no cotejo dos prós e contras, a privatização no Brasil não é a melhor solução para estancar o processo de desestruturação do sistema prisional brasileiro. Portanto, se concluiu que a privatização configura a mercantilização do crime, travestida de um projeto de ressocialização e de uma retórica para legitimar a indústria do cárcere. The Privatization of the Prison System has generated great discussions and controversial doctrinal positions. It is well known that the Brazilian prison system is experiencing structural chaos. Therefore, much is discussed about the alternatives or possibilities for solving this problem, for example, privatization. Therefore, this work aims to analyze aspects of the privatization of the penitentiary system, seeking to identify whether this is the best solution for improving the current prison precariousness, or would it be the legalization of the commercialization of criminal execution through the approach of the positive and negative aspects and the analysis of the unconstitutionality of privatization and the constitutionality of concessions. Secondly, to analyze one of the “privatization” models with a focus on the legal aspects of the implementation of the so-called public-private partnerships in the prison system, since the general limits of interference by prisons are discussed, as well as what would be the advantages and disadvantages of this interference in the administration of the prison system, bringing to the body of work notes on the Prison Complex of Ribeirão das Neves in Minas Gerais. The methodology used was bibliographic documentation, through the analytical method, with the study of scientific articles, doctrines, legislation relevant to the subject and books, to demonstrate that, in comparing the pros and cons, privatization in Brazil is not the best solution to stop the process of dismantling the Brazilian prison system. Therefore, it was concluded that privatization configures the commodification of crime, disguised as a resocialization project and a rhetoric to legitimize the prison industry.
