Jurisdição e competência: os plantões judiciários a partir da ótica dos princípios processuais constitucionais

The purpose of this study is to study perceptions brought about by forensic practice, which reveals that the prior disclosure of judicial scales coupled with procedual bad faith may lead many lawyers to try to circumvent the legal system for their own benefit, failing to join an action during the forensic expedition, because they already know the position of the titular magistrate, to appeal to the magistrate on call and, thus, to see their claim fulfilled. To do so, we will make a brief conceptual explanation about the civil procedural principles, in the light of the Constitutional Civil Procedure, crossing the structural guarantees of the jurisdiction and the resolutions that regulate the judicial work, in addition to a study on article 905, sole paragraph, of the Code of Civil Procedure. O presente trabalho tem como objetivo estudar percepções trazidas pela prática forense, que nos revela que a prévia divulgação das escalas de plantão judiciário conjugada com a má-fé processual pode levar muitos advogados a tentarem burlar o sistema jurídico para próprio benefício, deixando de ingressar com uma ação durante o expediente forense, por já conhecerem o posicionamento do magistrado titular, para recorrerem ao magistrado plantonista e, assim, verem sua pretensão atendida. Para tanto, faremos breve explicação conceitual acerca dos princípios processuais civis, à luz do Processo Civil Constitucional, perpassando as garantias estruturais da jurisdição e as resoluções que regulamentam os plantões judiciários, além de estudo a respeito do artigo 905, parágrafo único, do Código de Processo Civil.
