Análise tributária sobre a viabilidade das criptomoedas no Brasil

This scientific article critically discusses cryptocurrencies in the national scenario, with the
aim of verifying the feasibility of regulation. Through dialectical methodology, deductive and
with a critical bias and under the foundation of neoconstitutionalism. Therefore, this article
discusses the origin, concept and species of cryptocurrencies. Furthermore, the concepts of
the legal nature of cryptocurrencies in Canadian, German, Argentine, US, Japanese and
Brazilian legal systems are examined. And, also, the problem of volatility and the difficulty of
delimiting the power-to-tax of cryptocurrencies is presented. The result of this article is that
regulation is an instrument to increase the legal security of users of cryptocurrencies and
should take place based on the tax species that already exist in the Brazilian legal system,
without creating a new tax species. O presente artigo científico discorre criticamente sobre as criptomoedas no cenário nacional,
com o objetivo de verificar a viabilidade de regulamentação. Por meio da metodologia
dialética, dedutiva e com um viés crítico e sob o fundamento do neoconstitucionalismo. Para
tanto, este artigo discorre sobre a origem, o conceito e as espécies de criptomoedas. Ademais,
são examinadas as conceituações da natureza jurídica das criptomoedas nos ordenamentos
jurídicos canadense, alemão, argentino, estadunidense, japonês e brasileiro. E, também, é
apresentado o problema da volatilidade e a dificuldade de delimitar a competência tributária
das criptomoedas. O resultado deste artigo está no sentido de que a regulamentação é um
instrumento para ampliar a segurança jurídica dos usuários das criptomoedas e deve ocorrer
com base nas espécies tributárias já existentes no ordenamento brasileiro, sem que se crie uma
nova espécie tributária.
