A era de publicização do inquérito policial e a face brasileira da labelling approach theory

This work aims to relate the Labeling Approach Theory with relevant aspects present
in the elaboration of the Police Inquiry model adopted in Brazil. In the foreground, we use the
literature produced mainly by Norbert Elias and Howard Becker, exponents of the theory, to
illustrate the criminological thinking adopted here. According to this theory, the class
responsible for defining what conduct is considered a crime (for Norbert Elias, the
"established") use the law to punish behaviors related to the marginalized classes, which they
fear. The definition of criminal is steeped in subjectivism and becomes a label to be
distributed to anyone connected with these classes, even if they have not committed any
crime. Then, this research starts to characterize the Brazilian Police Inquiry, marked, above
all, by the exclusion of the defense of the pre-procedural phase, since the investigated person
has no right to the contradictory or the production of evidence at this stage, and the publicity
of the investigations. As will be seen, the absence of broad defense during the Inquiry phase
runs against the European and American Procedural Codes which, in keeping with the
constitutional order that was established after World War II, sought to increase the protection
afforded to the passive pole of criminal proceedings, guaranteeing their right to request
evidence and judicial control at the inquisitorial stage. In this context, the draft of the New
Code of Criminal Procedure, which has been in progress for ten years, intends to insert into
the national legal system legislative innovations that will take care of democratizing the
Police Inquiry, including the possibility of defensive investigation, creating an active defense
during the Inquiry and giving birth to the figure of the Judge of Guarantees, Magistrate
specially designated to control the legality of acts of the pre-procedural phase. Moreover, it
will be demonstrated that the trend observed in recent years is the reversal of the rule
provided for in Article 20 of the Brazilian Criminal Procedure Code, which establishes the
secrecy of the findings, and becomes their publicity. In criminal cases of greater social
repercussion, the Inquiry has been transformed into media entertainment, broadcast on
television newspapers for the entire population to have access to and form their opinion on the
authorship of a particular crime. Therefore, the exclusion of the inquiry's defense, coupled
with its publicity to the detriment of the secrecy required by law, contributes to adding a new
face to the Labeling Approach Theory. In Brazil, those who are the target of any criminal
investigation, even if not convicted, are labeled as "criminals", which is a flagrant violation of
the Constitutional Principle of Presumption of Innocence. In view of this, it is concluded that
the Brazilian Police Inquiry must be adequately adapted to the current constitutional order, so
as to contemplate a democratic criminal process, aware that it cannot arise from a purely
inquisitorial pre-procedural phase. Este trabalho possui por finalidade relacionar a Labelling Approach Theory (ou Teoria
do Etiquetamento Social) com relevantes aspectos presentes na elaboração do modelo de
inquérito policial adotado no Brasil. Em um primeiro plano, utiliza-se da literatura produzida,
principalmente, por Norbert Elias e Howard Becker, expoentes da teoria, para ilustrar o
pensamento criminológico aqui adotado. Segundo esta teoria, a classe responsável por definir
quais condutas são consideradas crimes (para Norbert Elias, os "estabelecidos") utilizam da
lei para punir comportamentos relacionados às classes marginalizadas, as quais temem. A
definição de criminoso encontra-se mergulhada no subjetivismo e transforma-se em uma
etiqueta a ser distribuída a qualquer pessoa ligada a essas classes, ainda que não tenha
cometido qualquer crime. Em seguida, esta pesquisa parte para caracterização do inquérito
policial brasileiro, marcado, sobremaneira, pela exclusão da defesa da fase pré-processual,
uma vez que o investigado não possui qualquer direito ao contraditório ou à produção de
provas nesta etapa, e pela publicidade das investigações. Conforme se verá, a ausência de
ampla defesa durante a fase de inquérito está na contramão dos Códigos Processuais europeus
e norte-americano, que, atentando-se à ordem constitucional que se instalou após a Segunda
Guerra Mundial, trataram de aumentar a proteção concedida ao polo passivo do processo
penal, garantindo o seu direito a requerer provas e ao controle judicial na fase inquisitorial.
Nesta esteira, o anteprojeto do Novo Código de Processo Penal, em tramitação há longos dez
anos, pretende inserir no ordenamento jurídico pátrio inovações legislativas que cuidarão de
democratizar o inquérito policial, incluindo a possibilidade da investigação defensiva, criando
uma defesa ativa durante a fase de inquérito e dando luz à figura do juiz das garantias,
magistrado designado especialmente para controlar a legalidade dos atos da fase
pré-processual. Ainda, demonstrar-se-á que a tendência observada nos últimos anos é a de
inversão da regra prevista no artigo 20 do Código de Processo Penal, que estabelece o sigilo
das apurações, e passa a ser a publicidade destas. Nos casos criminais de maior repercussão
social, o inquérito vem se transformando em um entretenimento midiático, transmitido em
jornais televisivos para que toda a população tenha acesso e forme sua opinião a respeito da
autoria de determinado crime. Tem-se, portanto, que a exclusão da defesa do inquérito, aliada
à sua publicidade em detrimento do sigilo exigido pela lei, contribuem para adicionar uma
nova face à Labelling Approach Theory . No Brasil, são etiquetados como "criminosos"
aqueles que são alvo de qualquer investigação criminal, ainda que não condenados, o que
constitui flagrante violação ao princípio constitucional de presunção de inocência. Diante
disso, conclui-se pela necessidade pungente de adequação do inquérito policial brasileiro à
ordem constitucional vigente, de forma a contemplar um processo penal democrático, ciente
de que este não pode surgir de uma fase pré-processual puramente inquisitorial.
