| dc.description | This article aims to provoke reflection about the effectiveness of the health‟s right in Brazil. In the beginning, seeks the concept of health, a complex notion with great reflection in understanding how the health practices operates. Then goes to a historical analysis of the positivation of the health‟s right, culminating in the art. 196 of the Federal Constitution of 1988. In addition to the health‟s right, the new policy letter recognizes various social rights, and the health promotion becomes a State‟s duty. However conformism and impunity has checkmated the controlling power of the constitution. The maturation of Brazilian institutions has raised the need for special protection of human dignity and the health‟s right, essential to a dignified life. When, however, the state does not provide the health‟s right as provided by law, the person concerned may demand it through the courts. However, there are limits to this feature, since one cannot demands the impossible. On the other hand, the Brazilian State has, then, to rely on German theory of the reservation of possibility to evade the constitutional duty to promote public health. It is necessary, therefore, that the state seeks through the Executive and Legislative maximum effectiveness of this law, the judiciary being placed as a guarantee that at least the minimum to be provided with a view to a real effectiveness of the health‟s right in the fundamental law of the country. | |
| dc.description | Este trabalho visa provocar uma reflexão a respeito da eficácia do direito à saúde no Brasil. Inicialmente, busca-se o conceito de saúde, uma noção complexa com grande reflexo na compreensão de como operam as práticas de saúde. A seguir passa-se a uma análise histórica da positivação do direito à saúde, culminando com o art. 196 da Constituição Federal de 1988. Além do direito à saúde, a nova carta política reconhece diversos direito sociais, nela a promoção da saúde passou a ser um dever do Estado. Contudo o conformismo e a impunidade têm colocado em cheque o poder dirigente da constituição. O amadurecimento das instituições brasileiras tem levantado a necessidade de especial proteção da dignidade da pessoa humana, e do direito à saúde, essencial a uma vida digna. Quando, porém, o Estado não prestar o direito à saúde na forma da lei, poderá o interessado exigi-lo pela via judicial. Todavia, há limites para esse recurso, visto que não se pode exigir o impossível. Por outro lado, o Estado Brasileiro passou, então, a invocar a teoria alemã da reserva do possível para se eximir do dever constitucional de promover a saúde pública. É necessário, portanto, que o Estado busque através do Poder Executivo e Legislativo a máxima efetividade deste direito, sendo o judiciário colocado como garantia de que pelo menos o mínimo seja prestado com vistas à eficácia real do direito à saúde preconizado na lei maior do país. | |
