dc.descriptionThe present work, based on the method of bibliographical revision, has as its theme the Brazilian migratory policy, specifically with regard to foreigners who seek Brazil to establish housing arising from humanitarian crises faced by their countries of origin analyzed under the humanist bias of ethics of otherness. It pervades the apogee of international organizations and treaties, as well as its legislative history in the framework of the Brazilian order and the institute of the refuge after the events of World War II. In addition, it analyzes the meaning of the ethics of alterity as responsible for the human commitment with the foreigners and observes its relation with the development of the institute of the humanitarian visa in Brazil. It deals with the context of the humanitarian visa of Law No. 13,445 / 2017 as an unfolding of the migratory flow in Brazil and of the specificities and peculiarities of the motivations of refuge requests in recent years. It also notes that Law 13.445 / 2017 lacks the Brazilian system in regulating the residence permit visa for humanitarian purposes as an exit from the legislative limitation of refugee status and stresses the responsibility for the protection of foreigners as a way to combat crisis raising its challenges and suggesting a humanist vision for the issue.
dc.descriptionO presente trabalho, a partir do método de revisão bibliográfica, tem como temática a política migratória brasileira, especificamente no que tange aos estrangeiros que buscam o Brasil para estabelecer moradia oriundos de crises humanitárias enfrentadas por seus países de origem analisada sob o viés humanista da ética da alteridade. Perpassa acerca do apogeu de organizações e tratados internacionais, bem como seu histórico legislativo no âmbito do ordenamento brasileiro e do instituto do refúgio após os acontecimentos da Segunda Guerra Mundial. Ademais, analisa o significado da ética da alteridade como responsável pelo comprometimento humano com os estrangeiros e observa sua relação com o desenvolvimento do instituto do visto humanitário no Brasil. Trata do contexto do visto humanitário da Lei 13.445/2017 como um desdobramento do fluxo migratório no Brasil e das especificidades e particularidades das motivações das solicitações de refúgio nos últimos anos. Observa, ainda acerca da Lei 13.445/2017, a morosidade do sistema brasileiro em regulamentar o visto de autorização de residência para fins de acolhida humanitária como saída à limitação legislativa de significação de refugiado e frisa a responsabilidade pela proteção dos estrangeiros como forma de combater a crise humanitária suscitando seus desafios e sugerindo uma visão humanista para a questão.
