Work, understood as the engine of human life, comprises the basis for this study, since social
relationships are woven within this activity inside organizations. In these relationships, it is
possible to verify the logic of domination marked by the structuring of alibis, who, instead of
repudiating insidious behaviors, ultimately stimulate them. The work place, therefore, due to
the moral harassment epidemic, ceases to value the richness and depth of human experience
and subjugates it to the muzzle of fear. In order to understand this process, this study was
carried out guided by different perspectives, as there is a lack of research that goes beyond the
victims perspective in the literature about moral harassment. The overall goal was to identify
the delineated differences and similarities between the verified proceeding
sentences/processes, and analyze the different discourses of the legal documents of
proceedings of the victims and of the managers of the accountable organizations, taking as
reference some of the categories of harassment, such as: multicauses, consequences, victim s
profile, harassment typology (vertical, horizontal or mixed), the offender s profile and moral
harassment as a process. It also encompasses the subcategories of moral harassment as a
process, which consist of: the duration of the violence, stages, aggressor s tactics and victim s
reaction. The case study, as a strategy for methodological procedure, was chosen taking the
Labour Court of the jurisdiction of Uberlândia/MG as reference. In the first phase of the
research, 243 cases related to moral harassment at work were raised between the period of
2007 and 2011, of which 49 were confirmed. Shortly after, it was possible to analyze 10
cases, based on two criteria where women stood out as targets, and big private corporations as
the stage for the moral harassment (both in the theoretical scope and in the analysis of files
relevant to the first stage of the research). These women s narratives were recorded and
transcribed for discourse analysis, as well as those by the people in charge of the
organizations (occupying the highest positions at the branch) where such cases took place. In
addition, the legal documents of proceedings that show the two versions (plaintiff s and
defendant s) and the legal decision were analyzed. The results show significant differences in
the categories between the perspective of the victims and that of the interviewed managers,
and also point out multidirectional mediations from the contribution of the different views. To
finish, preventive mediation is considered as essential to prevent the ripple effect of the
process, which is fed back by the evil consequences of this type of violence, characterized by
torn opportunities. Mestre em Administração O trabalho, compreendido como motor da vida humana, caracteriza-se como o pano de
fundo deste estudo, já que relações sociais são tecidas no âmbito dessa atividade nas
organizações. Relações essas em que se nota a lógica da dominação assinalada pela
estruturação de álibis que, em vez de repudiarem comportamentos insidiosos, acabam por
estimulá-los. O espaço do trabalho, portanto, a partir da epidemia do assédio moral, deixa de
valorizar a experiência humana, rica e profunda, subjugando-a à mordaça do medo. No intuito
de compreender esse processo, este estudo guiou-se a partir de diferentes óticas, posto que na
literatura existam carências de pesquisas que abordem para além da ótica das vítimas, quando
o assunto é assédio moral. O objetivo geral delineado foi identificar as divergências e
convergências entre as sentenças/processos procedentes verificados, bem como analisar os
distintos discursos dos autos, das vítimas e dos (as) gestores (as) das organizações
responsabilizadas, adotando como referência algumas das categorias do assédio, tais como:
multicausas, consequências, perfil da vítima, direções do assédio, perfil do agressor e assédio
moral como processo. Abarcaram-se também as subcategorias do assédio moral como
processo, sendo essas: a duração da violência, fases, táticas do agressor e reação das vítimas.
O estudo de caso, como estratégia de procedimento metodológico, foi escolhido tendo como
ponto de referência a Justiça do Trabalho, da jurisdição de Uberlândia/MG. Na primeira fase
da pesquisa, levantaram-se 243 casos relacionados a assédio moral no trabalho durante o
período de 2007 a 2011, em que 49 desses foram procedentes. Na sequência, foi possível
analisar 10 casos, com base em dois critérios em que se destacaram (tanto
no arcabouço teórico quanto na análise de arquivo pertinente à primeira fase da pesquisa)
mulheres, como alvo, e empresas privadas de grande porte como palco do assédio. As
narrativas dessas mulheres foram gravadas e transcritas para análise do discurso, bem como as
narrativas dos(as) responsáveis pelas organizações (cargo máximo ocupado na filial) em que
tais casos ocorreram, ademais, os autos que mostram as duas versões (reclamante e
reclamada) e a decisão jurídica foram analisados. Os resultados mostram divergências
expressivas nas categorias entre a ótica das vítimas e dos (as) gerentes entrevistados (as), mas
também apontam mediações multidirecionais, a partir da contribuição das visões. Por fim,
considera-se a mediação preventiva essencial para evitar o processo em efeito cascata.
Processo esse retroalimentado pelas consequências maléficas dessa tipologia de violência
caracterizada por dilacerar oportunidades.
