Resumen
A judicialização da saúde é a possibilidade de acessar o Poder Judiciário requerendo pres-tações de saúde que não foram cumpridas. Esse fenômeno nasce a partir do momento que o direito à saúde foi positivado na Constituição Federal de 1988 (CF/88). Assim, ao longo dos anos foi aumentando o número de ações judiciais na área da saúde, o que gerou inúmeros pro-blemas para os usuários e para os poderes do Estado, principalmente o Executivo e o Judiciário. Nesse contexto, esse trabalho teve como objetivo analisar a evolução da judicialização da saúde no Brasil. Para isso, foi realizado uma revisão da literatura que embasou uma proposta de teoria que estratifica a judicialização da saúde no Brasil em quatro classificações: a judicialização positiva; negativa; assessorias técnicas e desjudicialização. Essa classificação foi proposta para compreender a evolução, as experiências, o papel de diferentes instituições estatais e não estatais no fenômeno da judicialização da saúde no Brasil e a possibilidade de pactuação entre os atores que participam. A estratégia de pesquisa utilizada foi a realização de quatro estudos de caso representativos de cada classificação. Para isso, utilizou-se dados secundários da lite-ratura que foram recolhidos através da elaboração de um protocolo de coleta de dados. Foram selecionados 113 textos científicos para descrição dos casos. Após a descrição de como o por que os casos ocorreram, foram feitas as análises de acordo com os objetivos. Dessa forma, o estudo concluiu que ocorreu ao longo dos anos uma evolução institucional para melhor lidar com os problemas que envolvem os efeitos da judicialização da saúde no Brasil, e que há inici-ativas embrionárias para consolidar desjudicialização da saúde, que pode ser considerada uma boa opção para lidar com as demandas judiciais. The judicialization of health is the possibility of access to the judiciary requesting health care that has not been fulfilled. This phenomenon arises from the moment that the right to health was affirmed in the Federal Constitution of 1988 (CF / 88). Thus, over the years the number of lawsuits in the health area has increased, which has generated numerous problems for the users and for the powers of the State, especially the Executive and the Judiciary. In this context, this study aimed to analyze the evolution of health judicialization in Brazil. For this, a review of the literature was based on a proposal of theory that stratifies the judicialization of health in Brazil in four classifications: positive judicialization; negative; technical advisory and adjudication. This classification was proposed to understand the evolution, the experiences, the role of dif-ferent state and non-state institutions in the phenomenon of health judicialization in Brazil and the possibility of agreement among the participating actors. The research strategy used was the realization of four case studies re-presenting each classification. For this, we used secondary data from the literature that were collected through the elaboration of a protocol of data collec-tion. 113 scientific texts were selected to describe the cases. After the description of how the cases occurred, the analyzes were done according to the objectives. Thus, the study concluded that over the years there has been an institutional evolution to better deal with the problems that involve the effects of the judicialization of health in Brazil, and that there are embryonic initi-atives to consolidate health detrimentalization, which can be considered a good option to deal with lawsuits.
