Operatividad del principio de doble conformidad en el proceso disciplinario: vicisitudes administrativas, legales y jurisprudenciales a la luz de la Ley 1952 de 2019.

Abstract

The present academic article has as a problem question: In what way is the principle of double conformity operational within the Colombian disciplinary process regarding Law 1952 of 2019? And in turn, as a sub-question that complements this first question, what modifications in administrative, legal and jurisprudential terms are applicable from the operation of double compliance in the disciplinary process? From which it seeks to analyze the figure of double conformity and its operation in the Colombian State from public law, intending to analyze its treatment in the face of the disciplinary process developed by Law 1952 of 2019. In this investigation, the transition is studied that this figure has suffered from criminal law to recognition in disciplinary law and how currently it is not fully guaranteed, since Colombia in its legislation has not complied with conventional standards, preventing a pertinent development in the regulation and application of this figure.
